［뉴질랜드의 동물보호법］

뉴질랜드에서는 농림부(MAF: the Ministry of Agriculture and Forestry )산하에 뉴질랜드의 고유한 생태계를 보호하기 위한 생태환경안전국 (Biosecurity Authority) 이라고 하는 부서가 있고 이 곳에서 뉴질랜드의 생태계, 식물과 동물을 보호하는 업무를 관장합니다.

그리고 Biosecurity Authority 에서의 동물관련업무는 AEAC 와 AWAC 라고 하는 위원회가 중요한 역할을 하는데 AEAC는 동물윤리자문위원회(the National Animal Ethics Advisory Committee)로서 1984년에 설립되어 동물을 대상으로 하는 연구, 실험, 그리고 교육현장에서의 실습이 윤리에 어긋나지 않도록 하는 일들에 관한 것을, AWAC는 동물복지 자문위원회 (AWAC: the Animal Welfare Advisory Committee)로 뉴질랜드 농림부 장관에게 동물복지에 관한 것을 자문하여 주는 위원회로 1989년에 설립되었습니다.

AWAC 위원회에는 농업 관련산업 관계자, 동물복지활동가, 수의학과전문의, 동물심리행동학자, 소비자보호단체, 동물복지법 전문가, 그리고 뉴질랜드 농림부등이 멤버로 되어 있고, 더불어 AEAC의 전국총회장과 각지부의 협회장들도 AWAC의 멤버로 활동합니다.

뉴질랜드에는 영국으로부터의 정착민과 함께 영국의 가축학대방지법이 전해 들어오게 되었고 영국의 가축학대방지에 관한 동물보호법은 뉴질랜드의 1840년 법령에 그 일부가 사용되기도 하였으며 1878년에는 야생동물(wild animals) 과 가내동물 (domestic animals; 개나 고양이와 같이 집에서 기르는 동물) 을 모두 커버하는 동물학대법 (the Cruelty to Animals Act; 동물학대에 관하여 규정한 법)이 생기게 되었습니다.

1884년에는 경찰범죄법 (Police Offences Act) 에 의하여 1878년의 동물학대법은 폐지되고, 동물학대행위는 그 학대가 고의적인 경우뿐만이 아니라 방치에 의한 것일 경우에도 범죄행위로 간주되었습니다. 그리고 동물학대행위의 조사관에게는 특별경찰로서의 권한이 주어졌습니다.

1960년에는 동물보호법(the Animal Protection Act 1960)이 제정되어 동물학대행위방지의 행정권이 경찰에서 농림부(MAF)로 이양되었고 1960년의 동물보호법은, 동물을 이용하는 싸움 (animal fighting) 은 싸움을 주관하는 것만이 아니라 구경하고 참관하는 행위도 범법행위로 규정하였으며, 농장동물을 대상으로 한 학대행위의 범위가 확장되었고, 동물학대행위 조사관의 권한이 강화되었습니다.

그 후, 1960년에 제정된 동물보호법은 점진적으로 개정을 거쳐 오다가 변화된 시대의 사회상과 가치관을 반영하기 위하여 1990년에 AWAC 에 의하여 전면 검토되기 시작하였고, 2000년 1월부터 시행된 동물복지법 1999년 (the Animal Welfare Act 1999)에 의하여 대체되었습니다.

동물관련법을 제정하는 과정에 있어서 AWAC에서는 각 관련 산업 분야와 그리고 동물복지에 관심 있는 그룹들과 함께 심층 있는 협의와 자문과정을 거치고 나서 법안을 확정하고 승인합니다. AWAC에서 제정한 동물관련법 중에는 1992년 8월에 시행된 Code of Recommendations and Minimum Standards for the Sale of Companion Animals 로 굳이 직역을 하자면 ［반려동물판매에 있어서의 권고와 최소기준에 관한 법］과 1997년 11월에 시행된 Code of Recommendations and Minimum Standards for the Welfare of Dogs ［개의 복지를 위한 권고와 최소기준에 관한 법］등이 있고 AWAC에서 승인한 최소기준과 권고를 명문화한 동물관련법에는 이하에서 열거한 법들이 있고 이러한 법들은 동물관리법에 있어서의 새로운 방법의 출현, 나날이 앞서가는 과학지식, 또 사회의 가치변화에 따라 변화하는 시대와 사회상에 발맞추어 개정되고 있습니다.
